Terms of Service

1. Who we are and what these terms cover
SalesPulse+ ("the Service") is a multi-tenant field-sales CRM operated by Tikitech ("we", "us"), based in Bhandup, Mumbai, India. These Terms of Service ("Terms") govern your access to and use of the Service, including the SalesPulse+ web application and the SalesPulse+ Android mobile app published on Google Play.
By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
SalesPulse+ helps organizations track field-sales activities — meetings, attendance, projects, quotations, parties, and tasks — across web and mobile. The Service is sold to organizations ("Customers") who add their employees as users. If you use the Service as part of your job, your use is governed both by these Terms and by your employer's internal policies.
3. Accounts and access
- You must provide accurate information when creating or being added to an account, and keep it up to date.
- You are responsible for activity under your account. Keep your password confidential and notify your organization admin (or us) of any unauthorized use.
- Account access can be revoked by your organization admin at any time. We may also suspend access to enforce these Terms or to investigate suspected misuse.
- If your organization removes you from its tenant, your individual access to the Service ends. Your data within the organization remains the organization's data.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Upload content that infringes any third-party rights, contains malware, or violates the privacy of others.
- Attempt to access data that does not belong to your organization, probe or test the security of the Service, or interfere with its operation.
- Reverse-engineer, decompile, or otherwise extract source code or models from the Service except to the extent permitted by applicable law.
- Resell, white-label, or sub-license the Service without our written permission.
- Use the Service to send unsolicited messages or to harass, defame, or track individuals other than your colleagues during legitimate work.
5. Customer data
You and your organization retain ownership of the data you put into the Service ("Customer Data") — meeting notes, photos, voice recordings, contact details, project details, and so on. We process Customer Data only to provide and improve the Service, in line with our Privacy Policy.
You are responsible for the legality of the data you collect and store in the Service, including any consent your organization needs from contacts whose details you record.
6. Subscriptions and fees
- The Service is offered to organizations on a subscription basis. Pricing — including per-user fees, license caps, and any usage-based charges (such as AI token usage) — is set out in your organization's agreement with us.
- Invoices are issued monthly and are payable in INR unless otherwise agreed. Late payment may result in suspension of the Service.
- Pricing changes for an existing Customer become effective from the next billing cycle after notice.
- Subscription fees are non-refundable except as required by law or as explicitly stated in your organization's agreement.
7. Intellectual property
We own the Service — the SalesPulse+ software, design, and brand — and all improvements to it. These Terms do not transfer any of those rights to you. You may use the Service only for its intended purpose.
Any feedback or suggestions you give us may be used by us without obligation to you.
8. Third-party services
The Service uses third-party providers (Supabase for data hosting and auth, Railway for backend hosting, Google Maps Platform for location features, Expo for mobile push notifications, and AI providers including Google Gemini for message refinement and translation). Your use of features that depend on these providers is subject to their respective terms.
9. Service availability
We aim to keep the Service available, but we do not guarantee uninterrupted access. We may perform maintenance, updates, or rollouts that briefly limit functionality. We are not responsible for downtime caused by your network, your device, or third-party providers outside our control.
10. Termination
- You can stop using the Service at any time. Your organization can close its account by contacting us.
- We can terminate or suspend access if you breach these Terms or if your organization fails to pay outstanding invoices.
- On termination, your right to use the Service ends. We may delete Customer Data after a reasonable retention period unless your organization requests an export first.
11. Disclaimers
The Service is provided as is and as available. To the maximum extent permitted by law, we disclaim all warranties — express, implied, statutory, or otherwise — including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. AI-generated output (such as translation of meeting notes or summaries) is provided as a convenience and may contain errors; you should review it before relying on it.
12. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenues, lost data, or business interruption, arising from or related to your use of the Service. Our total liability for all claims relating to the Service in any 12-month period is capped at the fees your organization actually paid us for the Service in that period.
13. Indemnity
You agree to indemnify Tikitech against any claims, damages, or costs arising from your misuse of the Service, your violation of these Terms, or your infringement of any third-party rights through Customer Data you upload.
14. Changes to these terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. If a change materially affects your rights, we will notify you in the app or by email. Continued use of the Service after a change means you accept the updated Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising from or relating to the Service or these Terms is subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
